Terms of Service

These Terms of Service ("Terms") govern your use of vexofficial.store (the "Site") and any purchase you make from VEX ("VEX", "we", "us", "our"). By accessing the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Returns & Refunds Policy. If you do not agree, please do not use the Site.

1. Online store terms

You must be the age of majority in your province or territory of residence, or have the consent of a parent or legal guardian, to make a purchase. You agree to provide current, complete and accurate account and purchase information, and to update it as needed so we can complete your transactions and contact you about your order.

2. Products and pricing

All prices on the Site are in Canadian dollars (CAD). Applicable taxes and shipping charges are calculated and shown at checkout. We work to display product colours and images accurately, but we cannot guarantee that your device's display is exact. Product availability, descriptions and prices may change without notice. If a pricing or product error affects your order, we will contact you and offer a correction or a full refund for the affected item.

3. Pre-orders (DROP 001)

DROP 001 is currently presented as a preview only. Paid pre-orders are not open, and joining the email list is free, is not a reservation, and does not guarantee a specific item or size. Before paid pre-orders open, we will publish the pre-order window, the estimated dispatch window, payment terms and cancellation information on the Site and at checkout.

VEX sells pre-order items in batches: after a pre-order window closes, we place a consolidated order with our international supplier. International delivery to VEX typically takes around two weeks after the supplier order, but production, customs and carrier delays can extend this. After the products arrive, we inspect, pack and dispatch orders from within Canada; Canadian transit time is additional. Supplier and transit estimates are estimates only and are not guaranteed delivery dates. If an estimated dispatch date changes, we will notify affected customers and explain the available cancellation and refund options.

4. Orders and acceptance

Placing an order is an offer to purchase. Your order is accepted when we send an order confirmation. We may refuse or cancel an order — for example where an item is unavailable, a pricing error occurred, or a transaction cannot be verified — in which case any payment taken for that order will be refunded in full. Nothing in these Terms limits rights you have under applicable consumer protection legislation, including Alberta internet-sales rules.

5. Shipping, returns and refunds

We currently deliver to eligible addresses in Canada only. Shipping rates, delivery practices, returns, exchanges and refunds are described in our Shipping Policy and Returns & Refunds Policy, which form part of these Terms. In summary: standard shipping is CA$12 on merchandise subtotals below CA$150 after discounts, and free at CA$150 or more; return or exchange requests for delivered items are handled within the periods and conditions set out in the Returns & Refunds Policy.

6. Intellectual property

The Site and its content — including the VEX name and logo, product images, graphics and text — belong to VEX or its licensors and may not be copied, reproduced or used commercially without our prior written permission.

7. Acceptable use

You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorized access to the Site or its systems, to interfere with the Site's operation, or to submit false or misleading information. We may suspend or terminate access for misuse.

8. Disclaimer and limitation of liability

The Site is provided "as is" and "as available" without warranties beyond those required by law. To the maximum extent permitted by applicable law, our liability arising from a purchase is limited to the amount you paid for the affected product. Nothing in these Terms excludes or limits liability or consumer rights that cannot be excluded or limited under the laws of Alberta and Canada.

9. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta.

10. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site at the time of your order applies to that order. Material changes will be posted on this page with a revised "Last updated" date.
